Petitioned Ditch

The Union County Engineer is responsible for the maintenance and construction (as authorized by the commissioners) of all ditch improvements as petitioned by any benefited landowners in the county. The Union County Engineer  contracts  with the  Union Soil and Water Conservation District  to maintain the petitioned ditches.

 Petition to Construct a Ditch Improvement

There are three different methods by which a ditch may be petitioned.

  • County Ditch Petition  filed with the Union County Commissioners under  ORC 6131.04
  • SCS Ditch Petition  filed with the Union Soil and Water Conservation District under  ORC 1515.18
  • Mutual Agreement Petition  filed through the Union County Commissioners under  ORC 6131.63

* Proposed subdivisions follow Mutual Agreement procedures, but waive their right to a hearing. (  sample agreement  )

The process to construct a ditch improvement is governed by the Ohio Revised Code Sections  1515  and  6131  and summarized in this  flowchart  .

 Petitioned Ditches on Maintenance

Any ditch petitioned after 1957 is maintained through a special ditch maintenance fund as prescribed by Ohio Revised Code Section  6137  .
